    1. Application of the Terms

    1.1
    These terms and conditions apply to the use of the services provided to members (hereinafter referred to as “the Service”) by “TeamOncology.com” (hereinafter referred to as “the Program”), which is supervised by the University of Texas MD Anderson Cancer Center and hosted by the Oncology Education Project Association, and is provided to individuals (hereinafter referred to as “Members”) who have completed the membership registration in accordance with the procedures set forth in Article 2. The Service is operated by the Japan TeamOncology Program (J-TOP) Secretariat (hereinafter referred to as “Secretariat”).

    1.2
    When using this service, Members must agree to and comply with the contents of these Terms and Conditions.

    1.3
    These terms and conditions may be changed without prior notice as necessary. When the terms and conditions are changed, they will be posted on this site or communicated to the member via the email address registered by the member. In this case, if the member does not complete the cancellation procedure in accordance with the provisions of Article 5 within a certain notice period, the member will be deemed to have accepted the changed terms and conditions.

    1.4
    Those who have been receiving the Service prior to the establishment of these Terms and Conditions shall be subject to these Terms and Conditions as Members from the date on which these Terms and Conditions are established.

    2. Registration Procedure

    2.1
    Anyone who wishes to use this service (hereinafter referred to as the “Applicant”) must agree to these terms and conditions and register as a member (hereinafter referred to as the “Member Registration”) in the prescribed manner (such as registering on this website).

    2.2
    Membership registration is complete when the applicant receives a registration completion notification by email from the Secretariat. Upon completion of membership registration, a user ID and password (hereinafter referred to as “User ID and Password”) for using the Service will be issued.

    2.3
    If any changes occur to the member registration information, the member must promptly carry out the change procedures specified by the Secretariat (such as changing the information on this website).

    2.4
    If there is an error in the email address you provide when registering as a member, your registration will not be completed.

    2.5
    If it is discovered that the member registration information contains false information, the member registration may not be completed. Furthermore, even after the member registration has been completed, if it is discovered that the member registration information contains false information, the Secretariat may immediately cancel the membership of the member.

    3. Service details

    3.1
    This service is a members-only information service that provides members-only web content as stipulated in paragraph 2 and e-mail newsletters as stipulated in paragraph 3.

    3.2
    The Secretariat will provide members with member-only web content (hereinafter referred to as “Web Content”) for this service. Members will be able to view the Web Content using their user ID and password.

    3.3
    The Secretariat will provide members with a members-only e-mail magazine (hereinafter referred to as the “e-mail magazine”) for this service. Members can choose whether or not to receive the e-mail magazine by following the procedures specified by the Secretariat.

    3.4
    The Secretariat may send members emails other than the newsletter as necessary.

    3.5
    Members shall understand in advance that emails sent by the Secretariat may contain advertisements for products and services.

    3.6
    If a member fails to receive multiple emails regarding the delivery of a requested e-mail newsletter, the Secretariat reserves the right to stop delivery to that member without prior notice and to cancel the member’s membership.

    4. User ID and password

    4.1
    Members must manage and use their user ID and password responsibly to ensure that they do not become known to others.

    4.2
    Members may not allow others to use their user ID and password, nor may they lend, transfer, buy or sell them.

    4.3
    The Secretariat shall not be liable for any errors in the management or use of user IDs and passwords, or for any damages arising from use by a third party, except in cases resulting from the Secretariat’s intentional or gross negligence.

    5. Withdrawal

    5.1
    If a Member wishes to cancel his/her membership of this Service, he/she may do so by following the procedures specified by the Secretariat (such as canceling membership on this Site).

    6. Suspension of use of the Service

    6.1
    The Secretariat may suspend a Member’s use of the Service if the Member falls under any of the following items.
    (1) When a user ID and password are used illegally
    (2) If there is a violation or risk of a violation of these Terms of Use

    6.2
    If a member whose use of the Service has been suspended pursuant to the provisions of the preceding paragraph fails to resolve the issue despite being given a reasonable period of notice, the Secretariat may cancel the membership of that member. However, in emergency situations where it is unavoidable, the Secretariat may cancel the membership of that member without suspending the use of the Service.

    7. Handling of Personal Information

    7.1
    The Secretariat will use the members’ personal information within the scope of the purposes set out in the privacy policy of this service, and the members agree to this.

    7.2
    The Secretariat will endeavor to properly manage Members’ personal information in accordance with the privacy policy of this Service.

    7.3
    The Secretariat will not provide members’ personal information to third parties other than the Secretariat’s business contractors and the successors of the Secretariat’s related business, unless the member’s consent has been obtained in advance or it is permitted by law. Furthermore, when the Secretariat provides personal data handled by the Secretariat to a third party or when it entrusts the handling of personal data to a third party, the Secretariat will, unless there are special circumstances, take measures to prevent the third party from leaking or re-provisioning the information by means of a contractual obligation.

    7.4
    If a member requests the disclosure, deletion/correction, or suspension of use of his/her personal information (hereinafter referred to as “disclosure, etc.”), he/she shall contact the secretariat accordingly. In addition, a member may disclose, delete, correct, or suspend the use of his/her personal information on the “Change Member Information/Cancel Membership” page.

    8. Copyright

    8.1
    All content provided by this program in this service (web content and other information included in the e-mail magazine) includes materials, images, audio, and software (hereinafter referred to as “Content”). The copyright of the Content belongs to the supervisor, MD Anderson Cancer Center, or other rights holders. Members may not copy, reproduce, modify, publicly transmit, distribute, publish, or sublicense all or part of the Content for any purpose other than non-commercial and personal use without the permission of MD Anderson Cancer Center, Oncology Education Project Association, or other rights holders.

    8.2
    Members shall not falsify or remove any copyright or other proprietary rights or source indications on any Content.

    8.3
    Any emails sent by the Secretariat to members regarding this service are sent to the member’s address, and copying or modifying such emails may be a copyright infringement.Members may not make all or part of such emails available to third parties (this means publishing them on a website, forwarding such emails to an unspecified number of people, etc.) without the permission of the Secretariat.

    9. Changes, Suspension, and Abolition of the Service

    9.1
    The Secretariat may change, suspend (including temporary interruption of the Service for system maintenance, construction, or other reasons) or abolish all or part of the Service without obtaining the consent of the Members. However, except in emergency situations, if the Secretariat suspends or abolishes the Service based on this section, the Secretariat shall notify the Members in advance by the method specified by the Secretariat.

    9.2
    The Secretariat shall not be liable in any way for any disadvantage or damage suffered by a Member as a result of the change, suspension or abolition of this Service under the preceding paragraph.

    10. Disclaimer

    10.1
    The Secretariat may change, modify, improve or delete the content at any time without prior notice.

    10.2
    The Secretariat makes no guarantee to Members regarding the Service, including but not limited to that the Service will be available at all times, that the content of the Service is complete, accurate or useful, or that there will be no infringement of rights.

    10.3
    The Secretariat shall not be liable for any disadvantage or damage caused to members or other third parties as a result of this service.

    10.4
    Members shall use this service at their own risk.

    10.5
    If a dispute arises between a Member and another Member or a third party regarding the use of this Service, the Member shall resolve the dispute amicably between the parties and shall exempt the Secretariat from all liability.

    11. notification

    11.1
    Any notice or contact from the Secretariat to a Member pursuant to these Terms and Conditions will be made by posting on this Site, or by email or post to the email address or postal address registered by the Member.

    11.2
    Any notice or communication from Members to the Secretariat under these Terms and Conditions shall be made by mail to the inquiry or address on this site.

    12. Governing Law and Jurisdiction

    12.1
    These Terms and Conditions shall be governed by the laws and regulations of Japan.

    12.2
    Any disputes arising between a Member and the Secretariat in connection with this Service and these Terms and Conditions shall be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
